These Terms of Use refer only to the BFI Screenonline site located at www.BFI Screenonline.co.uk ("the Site") and not to any other websites operated or hosted by the British Film Institute ("the bfi")

By using the Site you agree to be bound by these Terms of Use. We reserve the right to amend these Terms of Use from time to time without notice to you and you agree to be bound by any such changes in your subsequent use of the Site.

The agreement between you and the bfi formed on the basis of these Terms of Use (the "Agreement") shall terminate immediately if you breach these Terms of Use. The bfi reserves the right to terminate this Agreement at any time. The termination of this Agreement or your right to use the Site is without prejudice to any rights which the bfi may have against you in respect of such breach.

Intellectual Property Rights

All materials available on the Site (the "Materials") - including but not limited to text, video clips, audio clips, designs, logos, illustrations and still images - are protected by copyright, trademark and other intellectual property and proprietary rights and must not be used for any purpose other than educational, non-commercial viewing purposes, unless otherwise stated in pop-up notices throughout the Site.

The Materials contained in the Site are either owned by the bfi or have been licensed by the owners to the bfi for inclusion within the Site. Under no circumstances may the Materials contained in the Site be copied, downloaded, reproduced, transmitted, broadcast, distributed or modified in any way, unless otherwise stated in pop-up notices throughout the Site.

The bfi would like to hear from any intellectual property rights owners who are not properly identified on the Site so that we may make the necessary corrections and display the appropriate notices.

ANY UNAUTHORISED USE OF MATERIAL ON THIS SITE MAY RESULT IN CIVIL AND CRIMINAL LIABILITY.

This Site contains material which may be unsuitable for people under the age of 18. The bfi bears no responsibility for people under the age of 18 viewing unsuitable material on this Site.

This Site contains material which some people may find offensive. The bfi would like to stress that it has no intention of causing any offence and suggests that people who find material contained on the Site offensive should either not view the material in question or should not visit the Site. The bfi bear no responsibility for any offence that may be caused by people viewing the Site.

The bfi makes no promise that the Site will meet your requirements or that the Site will be uninterrupted, secure or error free.

To the full extent allowed by applicable law, you agree that the bfi will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to your use of the Site.

Nothing in these Terms and Conditions shall exclude the bfi's liability for personal injury or death caused by its negligence.

As a convenience to users of the Site, the Site includes links to other web sites or material which are beyond its control. The bfi is not responsible for content on the Internet or World Wide Web pages outside the Site.

General

You hereby agree to indemnify the bfi against all actions, proceedings, costs, claims, damages and demands howsoever and whenever incurred or arising (including reasonable legal costs and expenses) in respect of or arising out of any breaches by you of your obligations, warranties or undertakings in this Agreement.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided by the English courts.
